The Magistrates Court of Western Australia deals with a wide range of civil and criminal matters and is able to deal with civil claims up to $75,000. The Magistrates Court can hear claims based on breach of contract (including employment contracts), but generally cannot enforce employment entitlements under awards or industrial agreements. These types of claims must be made to the Industrial Magistrates Court. Some claims in the Magistrates Court can be dealt with as a “minor case” if the total amount being claimed is less than $10,000. This means that lawyers are generally not allowed to be involved and the court is less formal in its procedures.
