Unfair dismissal

A dismissal may be unfair if you were not given a valid reason for dismissal. A dismissal can also be unfair if the employer doesn’t follow a fair process – for example, if you were not given a valid warning before your dismissal. There are many other reasons why a dismissal might be considered unfair.

Unfair dismissal protections are different for national system employees and state system employees. Not all employees can make unfair dismissal claims. For more information, see our fact sheets Unfair Dismissal for state system employees and Unfair Dismissal for national system employees.
